The Portland Art Museum (PAM) is committed to protecting the privacy of its visitors, members, and donors in accordance with applicable laws and regulations.

You agree that your use of portlandartmuseum.org and related websites and services (collectively, the “Services”) is subject to the following Terms and Conditions.

These Terms and Conditions may be modified at any time and periodically; the date of the most recent changes or revisions will appear on this page. Your continued use of the Services will constitute your acceptance of any changes or revisions to the Agreement and to our practices surrounding the collection, use, and sharing of your personal information as defined in this policy. If you do not agree with the Terms and Conditions, we do not authorize you to continue accessing the Services.

The materials contained on the website are provided by the Portland Art Museum as a service to you for your use on an “as is, as available” basis. You acknowledge that you are using the website at your own risk. The Portland Art Museum assumes no responsibility for errors or omissions in these materials. The Portland Art Museum makes no commitment to update the information contained herein. The Portland Art Museum makes no guarantees, and expressly disclaims any and all representations or warranties, express or implied, regarding the website, including without limitation the accuracy, completeness, or reliability of text, graphics, links, products and services, and other items accessed from or via the website or that the website will be uninterrupted, error-free, or free of viruses or other harmful components. No advice or information given by The Portland Art Museum or any other party on the website shall create any warranty or liability.

Website

All information gathered from you in connection with your use of this website (the “Site”) is governed by this privacy policy, and by using the Site or communicating with us by email, you agree to its terms and conditions. PAM is committed to protecting your privacy. We do not systematically collect or record names, addresses, phone numbers, gender identity or other personally identifying data (the “Personal Data”) from visitors to the Site, unless such data is voluntarily submitted by visitors for the purposes outlined below.

Information we collect

Our processing of personal information, such as your name, address, e-mail address, or telephone number, will be undertaken consistent with the requirements of applicable privacy laws, including, but not limited to, the Oregon Consumer Privacy Act of 2024 (the “OCPA”).

PAM uses the personal information you provide to us for internal purposes, such as fulfilling and tracking your order, analyzing trends, and collecting statistics. PAM may also compile and provide aggregate statistics about our visitors, customers, sales, traffic patterns and related site information to third parties, but these statistics will not include any Personal Data.

We may combine information you give to us online, by email, or in person at PAM. We may also combine this information with publicly available information and information we received from or have cross-referenced with our third-party vendors such as information collected from cookies and other technologies to improve your user experience, to communicate with you about products or events that may be of interest to you, or for other promotional purposes.

PAM has implemented Google Analytics Advertising Features including remarketing with Google Analytics, Google Display Network impression reporting, Google Analytics demographics and interest reporting, and integrated services that require Google Analytics to collect data for advertising purposes, including the collection of data via advertising cookies and identifiers. PAM and third-party vendors use first-party cookies (such as the Google Analytics cookie) or other first-party identifiers, and third-party cookies (such as Google advertising cookies) or other third-party identifiers together. 

Visitors can opt-out of the Google Analytics Advertising Features via Google Analytics’ currently available opt-outs for the web.

Linking

The PAM Site may include links to websites operated by third parties over which we have no control. Once you leave the PAM Site, the PAM Privacy Policy will not apply, and you access such sites at your own risk.

Email newsletter

We may record your email address if you email us, submit an online form that contains your email address, register for classes or events, purchase a membership or make a donation online, or opt to receive email notices of PAM programs, news, and events. We will never share your email address. 

Financial transactions & donor privacy

When you enter into a financial transaction with the PAM, including but not limited to purchasing a membership, making a donation, or purchasing online tickets, we and our third-party merchants and agents will request information necessary to process your transaction: your name, billing and shipping address, telephone number, email address and credit card information.

Your credit card information will be used only for the purpose of processing and documenting the transaction. We will never share, rent, or sell your credit card information to third parties.

We do not sell our donor, member, or visitor information. As is the common practice for nonprofits to attract new visitors and members, we may exchange the names and postal addresses we receive with other similar nonprofit organizations. 

We retain your information for as long as is necessary to process and fulfill your transaction or to comply with our legal obligations.

Your rights

If you are an Oregon resident, you may have the following rights with respect to certain personal information we process about you, to the extent required by the OCPA and subject to verification:

Right to Opt Out: The right to opt out of our targeted advertisements.

Right to Access: The right to confirm whether we are processing personal information about you and to access certain of such personal information in a useable format.

Right to Delete: The right to delete personal information we process about you.

Right to Correct: The right to correct inaccurate personal information about you.

The data controller for the purposes of OCPA or other data protection laws is the Portland Art Museum and PAM CUT // Center for an Untold Tomorrow.
